Jakarta remains Indonesia's capital, and the move to Nusantara awaits a presidential decree

Indonesia's Constitutional Court rejected a judicial review of Law Number 3 of 2022 on the Capital of Nusantara, in a ruling delivered in Jakarta on 13 May 2026.
Constitutional Justice Adies Kadir read the ruling.
The Court held that Nusantara has been legally designated as the new capital, but that the administrative transfer of the seat of government depends on a Presidential Decree.
In the Court's words, as long as the presidential decree regarding the relocation has not been established, the capital stays in Jakarta.
The petitioner, Zulkifli, had argued that enactment of the Jakarta Special Liaison Zone Law created a constitutional vacuum.
The Court responded that the Jakarta Law takes full effect only after the President signs the relocation decree.

Current capital: Jakarta Designated new capital: Nusantara Governing law: Law Number 3 of 2022 on the Capital of Nusantara Condition for the move: A Presidential Decree on relocation
Why it matters for exams: The capital of Indonesia is a frequently asked factual question and the Nusantara shift makes it a trap.
