Austria observed its National Day (Nationalfeiertag) on 26 October. About 1,200 recruits were sworn in at the Heldenplatz in Vienna in the traditional Angelobung ceremony. Federal President Alexander Van der Bellen said Europe's strategic environment has changed dramatically and that everyone should help preserve peace and freedom. Federal Chancellor Christian Stocker said the Nationalrat passed the Neutralitaetsgesetz 71 years ago, and that neutrality has never meant that others provide Austria's security. He named hybrid attacks, cyberattacks, dangers to critical infrastructure and disinformation as the threats Austria faces, and said the Bundesheer will be strengthened and the Wehrdienst developed further. Defence Minister Klaudia Tanner and Vienna Mayor Michael Ludwig also spoke. A wreath was laid in the crypt and there was a flypast by Eurofighter and C-130 Hercules aircraft.

The Verfassungsgerichtshof (VfGH), Austria's Constitutional Court, has repealed Paragraph 1a of the Weinbezeichnungsverordnung (WeinBVO) as unlawful. The decision, in cases G 99/2024 and V 56/2024, was announced on 15 October 2026 after an application by several Austrian winegrowers. The provision reserved the terms 'Erste Lage' and 'Grosse Lage' for DAC wines and required the Nationales Weinkomitee, an industry body with its own legal personality, to classify vineyard sites (Rieden) before the minister designated them by regulation. The Court held that the Weingesetz 2009 gave no statutory basis for handing such sovereign power to the committee, breaching the legality principle in Article 18 paragraph 2 of the Bundes-Verfassungsgesetz (B-VG), and that the committee's freedom from ministerial direction and supervision breached Article 20 paragraph 1 B-VG. The repeal takes effect the day after the decision is published in the Bundesgesetzblatt.
Cases:
G 99/2024, V 56/2024

The Verfassungsgerichtshof (VfGH) has dismissed challenges to provisions of the Strafprozessordnung (StPO), Austria's Code of Criminal Procedure, on obtaining and using evidence. The press release of 8 October 2026 covers judgments dated 29 September 2026 in cases G 123-124/2025, G 132-133/2025 and G 180/2025. Three people convicted at first instance of drug trafficking had raised the challenge in appeals to the Oberster Gerichtshof, Austria's supreme court. The VfGH held that decrypted encrypted chats obtained and passed on by foreign authorities may be used as evidence in Austrian criminal proceedings, and that the equality principle does not require Austria to apply its domestic exclusion rules to evidence gathered abroad. It said evidence obtained through torture, coerced self-incrimination or state-initiated incitement to crime remains excluded whether gathered at home or abroad. The provisions were found not to violate the fundamental right to data protection or the right to respect for private and family life.

The Verfassungsgerichtshof (VfGH) held its Verfassungstag ceremony in Vienna on 1 October 2026, the anniversary of the adoption of the Bundes-Verfassungsgesetz on 1 October 1920. VfGH President Christoph Grabenwarter said judicial independence must remain the top priority despite a tighter financial situation, and proposed giving the Court a say in promulgating its own repeals of laws, citing the experience of Hungary and Poland over the last 15 years. Federal President Alexander Van der Bellen said the constitution and liberal democracy need careful protection, that courts should explain their decisions clearly, and that citizens who take part responsibly in democracy act as guardians of the constitution. The keynote was given by Dieter Grimm, a former judge of Germany's Bundesverfassungsgericht, who analysed the April 2026 ruling of the Court of Justice of the European Union on Hungary's anti-LGBTIQ law as the first standalone finding of a breach of Article 2 of the Treaty on European Union, which sets out the EU's founding values. VfGH Vice-President Verena Madner also took part.

Statistics Austria reported on 5 October 2026 that low water levels slowed goods transport on the Danube in the summer of 2026. ORF's Lower Austria service reported on 6 October that freight traffic on the Austrian Danube in July and August fell by more than half against the summer of 2025, and that August tonnage was 74% lower than in August 2025. August was the second-lowest monthly transport volume since records began in the early 1990s; only January 1997, during an extreme cold snap with icing, was lower. Drought and low water were the cause, and ships that did sail carried smaller loads. Some freight shifted to rail and road. The Lower Austrian stretch of the river runs about 260 river kilometres and its main ports are Krems and Ennshafen, with agricultural products, chemicals and food the main cargo.

Statistics Austria published its air emissions accounts for 2024 on 16 October 2026, reporting that fossil carbon dioxide emissions decreased by 4.3% in 2024. Carbon dioxide from fossil fuels came to 40,973,600 tonnes, total methane to 245,970 tonnes and particulate matter PM10 to 28,769 tonnes. All three were lower than in 2008. The Wissenschaftsausschuss, the science committee of Austria's Nationalrat, approved an amendment to the GeoSphere-Austria-Gesetz on 30 September 2026 that makes GeoSphere Austria the operator of a national damage database for natural events. The bill was presented by Science Minister Eva-Maria Holzleitner and came before the full Nationalrat on 15 October 2026. GeoSphere Austria is to provide the data and analysis infrastructure for a central database meeting the criteria of the UN Office for Disaster Risk Reduction, building on CESARE, the national event and damage database it already runs for the Austrian Strategy for Disaster Risk Reduction. Only non-personal data will be processed. A new ten-member Kuratorium is to begin work on 1 October 2027 and six months are allowed for implementation. The database is meant for disaster preparedness, risk assessment and management planning, evaluating prevention measures, research, and meeting international and EU reporting obligations. The amendment was backed by the OeVP, SPOe, NEOS and the Greens, and opposed by the FPOe.
